On the occasion of World No Tobacco Day, the Minister of Health, Catherine Vautrin, unveiled a series of measures aimed at protecting the French people, and young people in particular, from the dangers of tobacco and nicotine. Among these announcements:

  • Ban on smoking in certain outdoor public places;
  • Intention to restrict flavors in vaping; 
  • Proposed reduction of the nicotine level in e-liquids.

Announcements that are generating many reactions in the vaping sector and among the community of ex-smokers. 

Ban on smoking in certain public places

From July 1st, 2025, the focus will be on preventing smoking and secondhand smoking among younger generations. As a result, smoking will be banned in all outdoor public spaces that accommodate children. This includes: 

  • Beaches; 
  • Public parks and gardens;
  • Areas around schools, middle schools, and high schools; 
  • Bus shelters;
  • Sports facilities.

The goal? To allow children to breathe "clean air", protect them from secondhand smoke and the normalization of cigarettes. Failure to comply with this ban may result in a fine of 135 euros. 

While vaping is not affected by this measure, the Minister of Health mentioned her intention to lower the nicotine level in e-liquids and ban certain flavors before the end of the first half of 2026.

The possible ban on flavors is back in the debate

Should flavors in vaping be banned or not? This question, asked countless times, has resurfaced in the debate following the minister's speech. 

Two camps face off: 

The pros: on one side, those in favor of the ban see it as a way to make e-cigarettes less attractive to young people who experiment with flavors like bubble gum, fresh fruit, and other sweet aromas that potentially create a "gateway effect" toward traditional cigarettes. 

The cons: on the other side, those in favor of flavors defend vaping as an effective way to quit smoking, provided that users find pleasure in it thanks to the flavors that make up the e-liquid. The gateway effect, which has not been proven, would also be non-existent among young people, since it seems unlikely that someone would trade a bubble gum taste for the naturally ashy/tarry taste of a cigarette. 

Forbidden to forbid: the case of Quebec

Quebec has banned flavors other than tobacco and fresh/mint in e-cigarettes since October 31, 2023. Our fellow vapers there can now only find tobacco, fresh/mint, and unflavored options in their favorite vape shops and convenience stores. 

Yes, but… a parallel market has developed for bottles of pure flavor concentrates to be added to e-liquids, with no precise dosage and no clear composition. This is legal in vape shops. 

The black market and more permissive Native American reservations have also built a parallel business with contraband e-liquids and disposable vapes of unclear origin and not always guaranteed composition.

The opening of this type of hidden market for such a benign product also paves the way for more dangerous products… gateway effect, here we go! 

Towards a smarter flavor ban?

Because it is true that certain vaping flavors can over time be more harmful than others (cinnamon and certain popcorn flavors, for example), and that many French flavor manufacturers and laboratories have been working for years to offer only healthy, safe, and reliable flavors, will the government lean toward a fairer and healthier ban? Stay tuned…

Reduction of nicotine in e-liquids

Another measure mentioned: the intention to reduce the maximum permitted nicotine level in e-liquids, currently set at 20 mg/ml under the European TPD directive. Presented as an initiative aimed at limiting addiction among young people, this announcement nevertheless raises many concerns among healthcare professionals, harm reduction associations, and vapers themselves.

Why? Because this high nicotine level is not intended for teenagers — who are already prohibited from purchasing nicotine products — but for adult smokers in the process of quitting. Vaping works on a fundamental principle: replacing the nicotine in cigarettes with that contained in e-liquids, but without combustion, tar, or carbon monoxide. For some heavily dependent smokers, a dosage of 20 mg/ml is essential to avoid relapsing into tobacco. 

Lowering this threshold would deprive the most dependent users of an effective tool for quitting tobacco, pushing them either to take more puffs — potentially increasing exposure risks — or to abandon vaping altogether and return to cigarettes. A public health paradox worth highlighting, because such a measure, however well-intentioned, could undermine the cause of public health. 

A regulated but preserved vape: finding the right balance

These recent announcements show a government desire to strengthen the fight against addiction, particularly among young people, which is obviously a commendable intention. But when it comes to vaping, the stakes are high: this is not a gateway product, but a cessation tool for millions of French people. 

Blindly banning flavors or drastically lowering nicotine levels means risking turning smokers away from an alternative that is far less harmful than tobacco. It also risks pushing some consumers toward a parallel, unregulated market where health and safety can no longer be guaranteed. 

Would the right path then be one of finer regulation, stronger oversight without depriving adult users of the essential tools for quitting tobacco? A dialogue between public authorities, healthcare professionals, scientists, and vaping industry players seems more necessary than ever.

Because behind these bottles and these sometimes "playful" flavors lies a very concrete reality: smokers trying to break free. Let's not forget them.
